Terms of use – Statisfy

Agreement

These terms are between you and Statisfy (“we”, “us”), the developer of Statisfy (“the app”). By downloading or using the app you accept them; if you don't, please don't use it. Our privacy policy explains how we handle personal data.

Using the app

Licence. You may use the app on Apple devices you own or control, under the Usage Rules of Apple's Media Services Terms. You may not sell, rent, redistribute, copy, modify or reverse-engineer it, except where the law allows.
Your music. The app plays files you provide, and you are responsible for having the right to use them. We don't supply music and never receive your files. Your music, playlists and history live only in the app on your device: deleting the app deletes them, and we cannot recover them, so keep your own copies.
Fair use. Don't use the app to break the law or infringe anyone's rights, to interfere with the app or the services it connects to, or to get around Premium or the ads.
Ownership. The app, its design, code, name and icon belong to us and our licensors. Your files remain yours.

Premium subscriptions

The app is free to download. Some features need a paid Premium subscription, as shown in the app and on our support page.

Premium is an auto-renewing subscription sold through the App Store. Plans, prices and any free trial are shown in the app before you buy.
Payment is charged to your Apple ID when you confirm the purchase, or when a free trial ends.
It renews automatically at the same period and price unless you turn off auto-renew at least 24 hours before the current period ends. Renewal is charged within the 24 hours before the period ends.
Manage or cancel it in Settings → your name → Subscriptions. You keep Premium until the end of the paid period. Deleting the app does not cancel a subscription.
Buying a subscription during a free trial ends the unused part of the trial, where applicable.
Refunds are handled by Apple at reportaproblem.apple.com; we can't issue them ourselves. Your consumer rights of withdrawal or refund are not affected.
Apple tells you in advance of any price change and, where required, asks for your agreement.

We may change what Premium includes. If we remove a significant feature you pay for, the change applies from your next renewal, so you can cancel before it.

Ads and third-party services

The free version shows ads from Google AdMob, according to the consent choices described in the privacy policy. We are not responsible for the content of those ads or where they lead.

Connecting Spotify, Dropbox or Google Drive is optional; when you do, their own terms also apply. They can change or stop what they offer to apps at any time, which may stop some features from working. Statisfy is not affiliated with, sponsored or endorsed by Spotify, Dropbox, Google or Apple.

Spotify

If you connect a Spotify account:

Spotify content shown in the app (such as artist names, track titles and artwork) belongs to Spotify or its licensors. You may not modify it, create derivative works from it, or use it outside the app.
Spotify makes no warranties or representations about the app and disclaims all liability for it, to the fullest extent the law allows. To that extent, Spotify is a third-party beneficiary of these terms and may enforce them against you directly.
Spotify is not responsible for the app, its support or its content. Questions about the app come to us, not to Spotify.

Changes and ending

We may add, change or remove features, and some updates may be needed to keep using the app. We may stop offering the app at any time; if you have an active subscription, you can ask Apple to refund the unused period.

You can stop at any time by deleting the app (cancel any subscription separately). We may end your licence if you seriously breach these terms. Ownership, disclaimers and the limits of liability continue after the terms end.

Disclaimer and liability

To the extent the law allows, the app is provided “as is” and “as available”, without warranties beyond those the law requires. We don't promise it will be free of errors or interruptions, or that stats from your listening or from third-party services are complete or accurate. Some features need an internet connection, and any carrier data charges are yours.

To the extent the law allows, we are not liable for indirect or consequential losses, or for lost data such as music files, playlists or listening history. Our total liability for any claim is limited to what you paid for Premium in the twelve months before it. Nothing here limits liability that the law does not allow us to limit, such as for death or personal injury caused by negligence or for fraud, or your statutory rights as a consumer.

Apple

These terms are between you and us, not Apple. In addition:

We, not Apple, are solely responsible for the app and its content.
Apple has no obligation to provide maintenance or support for the app. Support is provided by us at contact@statisfy.me.
If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any, of the app. To the maximum extent the law allows, Apple has no other warranty obligation regarding the app.
We, not Apple, are responsible for addressing any claims by you or a third party relating to the app or your use of it, including product liability claims, claims that the app fails to meet legal or regulatory requirements, and claims under consumer protection, privacy or similar laws.
We, not Apple, are responsible for the investigation, defence, settlement and discharge of any claim that the app or your use of it infringes a third party's intellectual property rights.
You confirm that you are not located in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country, and that you are not on any U.S. Government list of prohibited or restricted parties.
Apple and its subsidiaries are third-party beneficiaries of these terms and, once you accept them, may enforce them against you.

Updates to these terms

We may update these terms. We will change the date at the top of this page and, for significant changes, tell you in the app or its release notes before they apply. Continuing to use the app afterwards means you accept them. Questions: contact@statisfy.me.
